Terms and Conditions
of “Hostel Lekkerurlaub”, Graefestr. 89, 10967 Berlin
The following Terms and Conditions apply to bookings at the “Hostel Lekkerkurlaub” (hereinafter referred to as the Hostel):
1. Conclusion of Contract
The reservation is binding for both parties as soon as the Hostel has confirmed the booking request. A written confirmation by both parties, the Hostel and the Guest is essential. An electronic declaration of intent by the contracting parties is binding (e-mail, SMS).
Contractual partners are the Hostel and the Guest. If a Third Party has arranged the booking for the Guest this Third Party is liable together with the Guest as joint debtor for all incurred costs The Guest may not sublet or leave the rooms to Third Parties. The Guest is obliged to inform the Hostel in advance in the event of (co-)use by one or more persons and to obtain the consent of the Hostel. For damages resulting from a breach of this obligation, the Guest and, if applicable, the Third Party shall be liable.
2. Room Provision
The Guest is not entitled to the provision of certain rooms unless the Hostel confirmed the provision of a certain room. Check-in times are from 11 am to 2 pm. Reserved rooms must be occupied or confirmed by 6 p.m. on the day of arrival! Deviating check-in times are possible by prior arrangement. Please send us an e-mail at least 1 day before your arrival or call us to receive your personal check-in information.
The Hostel guarantees the reservation on the day of arrival until 7.30 pm, if no deviating individual arrival time was agreed upon. The Hostel has the right to cancel the reservation if the Guest arrives later without prior notification. Minors may only stay with the consent of a parent or legal guardian. The minor has to submit a copy of the identity card of the parent or legal guardian.
3. Damage and Loss
The Hostel is liable for proper performance of the services agreed upon in the contract. If the accommodation has a defect that goes beyond mere inconvenience, the Guest has to immediately notify the Hostel owner of the defect and demand remedy. For damage, destruction and soiling of the rooms and/or furnishings beyond proper use the Guest shall indemnify the Hostel for the damages incurred (i.e. for the purchase value of the goods). If the room because of damage, destruction or soiling cannot be rented further, the Guest shall also be liable for this further damage incurred.
The Hostel is not liable for loss of or damage to personal belongings. The Hostel is not responsible for guarding or storing personal belongings. In case of loss of the room key 35.-- Euro become due immediately for replacement of the key.
4. Price arrangements and Payment Modalities
Prices include VAT and city tax. Invoices will be shown on the spot with the correct tax.
If the time between conclusion of the contract and fulfilment of the contract exceeds 4 months and if the prices charged by the Hostel for services increase during this period, in particular due to increased wage costs or operating costs of the Hostel, the Hostel may raise the contractually agreed price by a reasonable amount, but not more than 15%. In this case, the Hostel will inform the Guest, who will then have the right to withdraw from the Agreement. The Hostel may change prices even if the Guest subsequently requests changes in the number of the booked rooms, the Hostel's services or the length of stay and the Hostel agrees.
The Guest pays immediately upon check-in in cash, by credit card or EC card. Hostel invoices are due immediately within 5 days without deduction. In the event of late payment, the Hostel is entitled to charge default interest at a rate of 5 percentage points above the base rate of the European Central Bank.
5. Cancellation
Cancellations have to be made in writing or electronically (e-mail, SMS). Unless otherwise agreed, the Guest can cancel at the latest on the day before the planned arrival until 12 noon. After this cancellation period, the total amount becomes due.
In the case of cancellation of group bookings (from 5 persons), 50% of the total amount is due if the cancellation is made within 31 calendar days prior to arrival. For cancellations from the 7th day before arrival, 100% of the total amount is due. Exceptions to these cancellation conditions when booking all rooms of the Hostel require individual agreement.
6. Departure
On the agreed day of departure, the rooms must be vacated and made available to the Hostel by 11:00 a.m. Thereafter, the Hostel may charge 80% of the full accommodation price for the additional use of the room until 18:00 hours, but at least 20.-- Euro.
